    Ellis: costly automobile insurance laws must be rolled back

    Legislation causing increases in automobile insurance rates by as much as 40 percent and more is outraging drivers all across Wisconsin and ought to be repealed. To that end, I am drafting legislation that will roll back changes inserted in the state budget, even though they have no relationship to state finances whatsoever.

    The bill, which already has the support of many of my Senate colleagues, will repeal budget provisions that increased the mandatory minimum amounts of liability coverage, increased the mandatory minimum amounts of uninsured-driver coverage and that mandated coverage for underinsured drivers. Provisions which allow for the stacking of up to three insurance policies will also be repealed in the proposal.

    These provisions never should have been put in the budget in the first place. We tried to remove them during action on the budget but thanks to almost every Democrat in the legislature and Governor Doyle they are now the law.

    Under the new law, Wisconsin drivers will go from having among the lowest insurance rates in the nation to having among the highest. According to Wisconsin insurers, automobile insurance rates will increase as much as 40 percent for most Wisconsin drivers.

    At a time when hard-working families all across our state are struggling to pay the bills, to pay their mortgages and even to put food on the table, these expensive mandates are absolutely unnecessary. Talk about kicking someone when they’re down -- the state budget already imposed more than $3 billion on Wisconsin taxpayers, and on top of that we’re going to jack up insurance rates even though that has absolutely no affect on the state’s bottom line.

    Additional unintended consequences could emerge when insurance becomes unaffordable to more and more drivers.

    If insurance rates become unaffordable, more people will risk driving without insurance, despite the new law requiring it. The result will be fewer drivers with insurance. That will lead to greater exposure and risk for insurers who will ultimately be forced to increase rates even more to cover that increased risk.
