    News Release: Embezzlement charges forthcoming, City of FDL employees

    Note: All persons are presumed innocent until proven guilty. This is an ongoing investigation and no further investigation details will be provided pending the investigation/prosecution. Information herein is provided due to the public nature of the issues involved in anticipation of public interest and press inquiry.

    CITY OF FOND DU LAC,
    Daniel Kaminsky, District Attorney, Fond du Lac County – Detective Sergeant Brian Liethen of the Village of North Fond du Lac Police Department, acting as lead special investigator under the supervision of Chief William Lamb, coordinated efforts yesterday which led to the execution of numerous search warrants and questioning of several individuals regarding three City of Fond du Lac MIS Department employees suspected of embezzling thousands of dollars in goods, primarily electronics, through a fraudulent ordering and invoicing scheme. Today’s operation involved the joint efforts of over forty police officers, both local and special agents of the Wisconsin Department of Justice, and Fond du Lac County District Attorney Daniel Kaminsky. The investigation spans multiple counties.

    The investigation has been ongoing covertly since late 2009. The matter was first brought to the attention of law enforcement when the attorney for a confidential informant contacted the District Attorney. Information suggests a sophisticated conspiracy to cause City funds to pay fraudulent invoices which cover up the ordering and purchasing of personal items. In addition, surplus parts belonging to the City may have been taken for personal use and/or sold for personal profit. The exact length of this conspiracy remains under investigation, but information suggests it dates back several years and involves at least one former employee.

    Due to the inherent conflict of investigating City employees, City of Fond du Lac Police Chief Tony Barthuly immediately sought the assistance of the Village of North Fond du Lac Police Department to act as special investigators. Until last week when coordinated efforts and manpower became necessary, all City of Fond du Lac personnel including the police were insulated from all but the basic investigation details.

    “We are very fortunate for the swift and concise efforts of law enforcement and the bravery of the confidential informant. Working together with City Manager Tom Herre, not only has the investigation progressed, but I believe everything has been done to minimize disruption in City operations. Absent these coordinated efforts, the alleged criminal activities of the these suspects may have continued to go unnoticed, costing taxpayers thousands of dollars more than what is already believed to have been stolen,” stated Kaminsky.

    “This is obviously a very difficult situation for the City of Fond du Lac. In conducting this investigation on their behalf we have moved as quickly as reasonably possible, but it’s a very complex and widespread criminal investigation and one that has required an extensive amount of time and evidence gathering. I cannot speak more highly of the courage, professionalism, and cooperation that have been demonstrated by a variety of officials – most notably city Manager Tom Herre and Chief Tony Barthuly. Their full cooperation, assistance, and commitment to the highest standards of accountability and ethics in government have played a key role in this investigation. I would also like to recognize and thank District Attorney Dan Kaminsky and the Wisconsin DOJ, Division of Criminal Investigations, for the time and resources they have committed to this investigation,” stated Lamb.

    The exact amount of money involved is still being determined as information is gathered and reviewed. The discovery of financial records and accounting is ongoing.

    Initial charges are anticipated from the District Attorney’s Office as the investigation reaches its conclusion.

    District Attorney Dan Kaminsky, Chief William Lamb, Chief Tony Barthuly, City Manager Tom Herre, and Department of Justice Officials will host a press conference on Wednesday, February 10, 2010, at 3:00 p.m. at the City of Fond du Lac Police Department,126 N. Main, Fond du Lac, Wisconsin, 54935.
